Athens Activists Take Their Fight to the Courts Again

An Athens County group that is attempting to challenge a state-issued permit related to a Troy Twp. injection well is taking the matter to court. 
Athens County Fracking Action Network has filed notice it will appeal to Franklin County Common Pleas Court last month’s decision by the Ohio Oil & Gas Commission to dismiss ACFAN’s challenge of the permit. In December, the Ohio Department of Natural Resources issued the permit to K&H Partners, which was developing its second injection well in Troy Twp., near Torch.

In its notice of appeal, ACFAN states that dismissal of its Oil & Gas Commission case was unlawful based on Ohio law, state regulations and under the federal Safe Drinking Water Act.

Franklin County Common Pleas Court is being asked to vacate the dismissal and order the commission to hold a hearing on ACFAN’s challenge of the permit.
